Harassed by a Debt Collector? How Does the FDCPA

By Law Office of Abel L. Pierre, Attorney at Law, P.C.

Being faced with mounting debt can be a extremely stressful experience, not only for you but for your family as well. Add to that the harassment and abusive tactics employed by many creditors and debt collectors and it may seem like there is no way out from under your financial burden. It is for that reason the federal government added the Federal Debt Collection Practices Act (FDCPA) to the Consumer Protection Act in 1978. The act was a measure taken to help encourage fair debt collection and protect consumers from the abusive collection activities and deceptive strategies being used to intimidate and coerce them into paying off a debt.

There are inherent protections provided through the FDCPA including but not limited to no debt collector can contact you by phone except between the hours of 8am and 9pm, they cannot engage in repeated and continuous phone calls with the intention of harassing or annoying you, debt collectors cannot use abusive, threatening or profane language, they cannot call you at your place of employment after you have informed them not to do so, they cannot misrepresent themselves or the debt in any fashion, they cannot threaten you with an arrest and they are not allowed to discuss your debt with a third party (other than your lawyer).

As soon you contact our firm and retain counsel from one of our knowledgeable debt collection defense attorneys, we will inform your creditors that you have retained legal counsel and all communications should henceforth be directed to our firm. This action alone with help relieve some of the immediate stress you face and allow you the time to learn about your available options.
