Illegal Background Checks
Before you are hired for a job, or promoted to a new position, your employer may decide to conduct a background check. These checks may include information obtained from:
- Credit records
- Driving records
- Vehicle registration
- Your social Security number
- Court records
- Personal references
- Character references
- Past employers
- Incarceration records
- Education records
- Medical records
- Property Ownership records
Unfortunately, information gathered by employment screening companies can be inaccurate, incomplete, or entirely false. A background check may include errors such as:
- Out-of-date information that is being presented as current
- Mistaken identity (this may occur in cases where the subject of the report has a common name)
- Items mistakenly categorized as criminal offenses
An inaccurate or erroneous background check report can have consequences that include damage to your chances for employment, or termination from your current job. If you have been victimized by an inaccurate background check, or a background check that was undertaken illegally, it is recommended that you contact a New York City debt collection defense attorney at Law Office of Abel L. Pierre, Attorney at Law, P.C. Our attorneys will work tirelessly in an effort to resolve the damage done by the incorrect background check. We may also be able to recover compensation on your behalf for any losses suffered as a result of the report.
Ineligible Background Check Items
The Federal Credit Reporting Act (FCRA) states that the following cannot be reported on a background check:
- Bankruptcies that are older than 10 years
- Paid tax liens that are older than 7 years
- Accounts gone into collection that are older than 7 years
- Civil suits, judgments, or records of arrest (from date of entry) that are older than 7 years
If you have experienced employment difficulties as a result of an illegal or erroneous background check, contact a New York City debt collection defense lawyer who may be able to help you resolve the situation.
